Wrongful Death- Westfield, NJ
In 2005, I secured a wrongful death settlement on behalf of a Westfield, NJ client who died as a result of being struck while crossing a street in a motor vehicle accident. The insurance company claimed that the defendant in this wrongful death claim was far from a cross-walk and was wearing dark clothing in an unlit area. Citing this position, the insurer originally refused to negotiate with my client’s family. As a New Jersey wrongful death lawyer with experience in dealing with insurers who don’t want to pay, I proceeded to put together the case to refute the insurer’s claims.
To negate what the insurer claimed, I set up a re-creation of this wrongful death case on the anniversary of the victim’s death. We created a video, filming at the same location and under the same circumstances as the victim’s wrongful death accident. The video made it clear that the motor vehicle accident that caused my client’s death was the defendant’s fault, and the insurer’s position would not hold up in a court case. The re-creation proved that the defendant in this wrongful death lawsuit was not accurate in its claims that my client was far from the cross-walk and difficult to see based on lighting conditions and clothing.
I used my experience with New Jersey wrongful death lawsuits to litigate this case against the insurer. After two years of litigation, the insurer tendered the entire policy limits. Based on the video re-creation, the insurer’s original position in this wrongful death claim; that my client was too far from the cross-walk and couldn’t be seen because he was wearing dark clothing in an unlit area; was proven to be false and invalid. The insurer was then forced to negotiate a wrongful death settlement with the victim’s family, as a result of my thorough discovery and exploration of this case through successful litigation.
As a successful New Jersey wrongful death attorney, I sympathize with the pain of my clients’ families, and I use my experience to get the settlements they deserve.
